DISCLOSURES IN REAL ESTATE
 

Whether buying or selling, there are a number of disclosures that will be produced during your real estate transaction.   Here are several of the disclosures you'll be seeing:

 

4      Agency Disclosure- This disclosure form reveals to the buyer/seller who the subject agent works for.

4      Transfer Disclosure- This form discloses to the buyer information about the property. The form includes information about the home systems, environmental and structural issues.

4      Lead-Based Paint Disclosure- This form is for housing built before 1978, when most paint included lead. This is a federally required disclosure and must be included in all older homes.

4      Local Disclosure- This may include disclosure of airport locations, public facilities, local building code issues, etc.

4      Buyer Advisory- With a finite amount of inventory, and often multiple offers on each transaction, buyers are willing to pull out all the stops to get their dream home, and they don’t always understand what that means. It’s part of the Realtor’s job to guide buyers through this hectic process and let them know exactly what to expect.

4      Seller's Statement on Repairs- This form makes it much easier for agents to document repairs, and helps clear up confusion on the part of both sellers and buyers.

4      Local Area Disclosure- The Risk Management Committee created this user-friendly booklet to put known disclosure issues unique to San Diego County at your fingertips.

4      Mold Disclosure Designed to explain the problems with mold and the necessity of obtaining a mold inspection

4      Seller's Additional Disclosures- Designed as an addendum to the Real Estate Transfer Disclosure Statement, this shows that agents have made a full effort to encourage complete disclosure, and acknowledging that the seller, and not the agent, is responsible for such disclosures.
